Please read them carefully before using the Services. By clicking “Agree,” registering, logging in, or using DR H, you acknowledge that you have read and agree to this Agreement and the applicable rules.
Please note: The configuration of business features may vary depending on the system version of your device. The Services listed below may not apply to certain models, and certain features may be unavailable on certain models. Please refer to the actual configuration. All rules concerning the collection and use of information apply only to the use of such information and the specific Service features provided to you.
DR H User Agreement
I. Application and Definitions
1. This DR H User Agreement (hereinafter referred to as this “Agreement”) is entered into by and between Zhihexin Technology (Shenzhen) Co., Ltd. and each user of the DR H application, website, device-connectivity services, Wellness Marketplace, and related features (hereinafter referred to as “you”).
2. DR H is an application that provides users with wearable-device connectivity, health-data display, health-trend insights, day-to-day health management, Family Health Sharing, access to transactions through the Wellness Marketplace, and other features. The specific features available to you are subject to the interfaces actually displayed, your device model, and the permissions you affirmatively enable.
3. This Agreement, the DR H Privacy Policy, the Family Health Sharing Rules, the Wellness Marketplace Platform Services Agreement, the Transaction Rules, the Order/Appointment Rules, the Payment Rules, the Refund and After-Sales Rules, all feature-specific service rules, and on-screen notices collectively constitute the agreement governing your use of the relevant Services. If any feature-specific rule conflicts with this Agreement, the feature-specific rule shall prevail; where laws or regulations provide otherwise, such laws or regulations shall govern.
II. Accounts, Eligibility, and Use Requirements
1. You shall provide registration information that is true, accurate, complete, and promptly updated, and shall properly safeguard your account, password, and verification codes. You shall be responsible for losses arising from your failure to safeguard such information, lending your account to another person, or authorizing another person to use your account, except as otherwise provided by law or where such losses are caused by our fault.
2. The Services are primarily intended for adults. A user under 14 years of age may use the Services only after a parent or other guardian has read and agreed to this Agreement and the rules on the protection of children’s personal information. Other minors shall use the Services under the guidance of a guardian. For Family Health Sharing, payments, appointments, psychological counseling, wellness care, nursing care, and similar features, the guardian shall act on the minor’s behalf and assume the corresponding responsibilities to the extent permitted by law.
3. You shall not use the Services to engage in any unlawful or non-compliant activity; infringe another person’s privacy, personality rights, intellectual property rights, or other lawful rights and interests; circumvent security measures; interfere with system operations; scrape data; or use the Services for commercial resale.
III. Health Data, Device Connectivity, and Scope of Services
1. After you authorize the relevant device permissions or bind a wearable device, we may collect, receive, calculate, display, or synchronize data generated by the device, including heart rate, HRV, RRI, blood oxygen, sleep, respiratory rate, skin temperature, stress, activity data, and ECG data. Details of such processing are set forth in the Privacy Policy and the relevant authorization interface.
2. Device measurements, algorithmic calculations, trend displays, and abnormality alerts may be affected by the device model, manner of wear, environment, network conditions, individual differences, missing data, and algorithmic limitations, and may therefore be delayed, inaccurate, or incomplete. You should exercise judgment in light of your own circumstances and should not rely solely on any device data, trend, alert, or AI-generated response when making a medical decision.
3. DR H provides health-management and informational services and is not a medical institution. It does not provide disease diagnoses, treatment recommendations, medical prescriptions, emergency rescue, psychological diagnoses, or services intended to replace physicians, psychological counselors, or other professionals. Except for third-party professional services expressly identified on the Wellness Marketplace page, we make no warranty as to any health outcome, professional conclusion, or service result.
Important Health Notice: If you experience chest pain, difficulty breathing, impaired consciousness, a risk of self-harm or harm to others, a persistent material abnormality, or any other emergency symptom, immediately contact local emergency services, visit a medical institution, or seek assistance from a qualified professional rather than relying on the Services.
IV. AI Health Features
1. After you affirmatively enable an AI health feature and grant authorization through the relevant interface, the feature may use the health data, reports, written materials, or questions you elect to provide to display health trends, identify conditions, explain materials, provide lifestyle suggestions, and offer health-management references. The categories of data that may be accessed are limited to the scope selected and authorized by you on the relevant feature interface.
2. AI-generated content is provided solely for general health-management reference. It may be inaccurate, incomplete, or inapplicable to your particular circumstances and does not constitute a disease diagnosis, treatment opinion, prescription, psychological diagnosis, or professional-service opinion. You should independently verify such content and, where necessary, consult a physician, psychological counselor, or other qualified professional.
3. Unless you make a separate affirmative election and provide separate consent, we will not use identifiable health materials uploaded, entered, or synchronized by you for model training, model fine-tuning, data labeling, or model optimization for other users. Information that has been lawfully anonymized and cannot be used to re-identify an individual may be used for statistics, product security, and service improvement to the extent permitted by law.
4. To maintain safety and quality, we may restrict features, display warnings, conduct human review, retain necessary records, or take other reasonable measures in response to content that is manifestly unlawful or non-compliant, endangers personal safety, or is otherwise inappropriate.
V. Family Health Sharing
1. Family Health Sharing becomes effective only after an invitation is issued and the invited person accepts it and selects the scope of authorization. The inviting party may view the invited person’s day-to-day health data and trends only within the scope expressly approved by the invited person; the invitation itself does not constitute authorization to access health data.
2. The invited person may at any time decline the invitation, adjust the scope of data, disable abnormality alerts, leave the family relationship, or terminate sharing. Upon termination, the inviting party may no longer view the invited person’s subsequently generated health data. Content lawfully viewed before termination, the scope of historical data, and abnormality alerts are governed by the Family Health Sharing interface and the applicable rules.
3. You shall not use information obtained through Family Health Sharing for discrimination, harassment, surveillance, commercial marketing, or any purpose beyond family health management. Where a minor, a person lacking or having limited civil capacity, or an older adult requiring guardian assistance is involved, a guardian with lawful authority shall act and comply with the identity-verification and authorization requirements displayed on the relevant interface.
VI. Location Permission
If you affirmatively use a location-based service or enable location permission to search for or connect to a Bluetooth device, we will obtain your separate consent through the relevant interface or system permission prompt. You may disable location permission in your device settings or App settings; after it is disabled, we will cease collecting new location information.
VII. Wellness Marketplace and Transactions for Third-Party Health Services
1. The Wellness Marketplace is a platform service centered on women’s and family health-management scenarios that connects selected third-party health services, membership benefits, and in-App transaction processes. Through the Wellness Marketplace, you may browse service information, place and pay for orders, submit appointment information, view orders, and submit refund or after-sales requests.
2. Unless otherwise expressly stated on the product or service detail page or the order-confirmation page, the third-party service provider is the actual provider of the offline service and is responsible for its qualifications, professional judgment, service performance, the content of reports/conclusions, and professional service quality. The Platform is responsible for displaying service information, providing transaction technology support and payment and refund interfaces, administering orders, and coordinating after-sales matters.
3. Before placing an order, you shall carefully review the service details, eligibility conditions, contraindications or risk disclosures, appointment requirements, validity period, cancellation/rescheduling terms, and refund rules, and confirm that the contact and appointment information is true and accurate. For physical examinations, psychological counseling, wellness care, nursing care, women’s health services, and similar items, you shall also execute or acknowledge the applicable service-specific agreement, informed consent, or risk-disclosure document with the actual service provider.
4. The service price, promotions, invoice issuer, method of collecting payment, refund channel, and ultimate contracting party are as expressly identified on the product-detail page, order page, payment page, and electronic voucher. The Platform will not exclude or restrict consumers’ statutory rights through unreasonable terms.
5. The Platform will accept and coordinate refunds or disputes arising from cancellation by the actual service provider, a material inconsistency between the service and its description, qualification issues, or performance issues in accordance with the applicable rules. If a loss is caused by an error in the Platform’s payment, ordering, or information-transmission functions, the Platform shall bear corresponding liability in accordance with law.
VIII. Third-Party Services, Provision of Personal Information, and Report Access
1. To complete a service that you affirmatively purchase or schedule, we may provide the actual service provider, to the extent necessary, with the order number, contact person, contact details, appointment time, service item, and other necessary information separately authorized by you. Health materials, psychological materials, or report synchronization will be processed subject to separate authorization or secondary confirmation.
2. Third-party service providers, payment institutions, logistics providers, cloud-service providers, SDK providers, and others process relevant information in accordance with their respective rules. We will require entrusted processors or recipients to protect information in accordance with contract and law; however, where a third party independently provides a service, it shall bear corresponding responsibility for its professional service and any processing activities it independently conducts in accordance with law.
3. Original psychological-counseling notes, verbatim transcripts, treatment-process records, and other highly sensitive professional files are, in principle, independently retained and managed by the actual service provider. The Platform processes such information only to the extent necessary to complete a transaction or provide after-sales support, or where you separately and expressly authorize specified materials and specified purposes.
IX. Fees, Refunds, and After-Sales Support
1. You shall pay in accordance with the price, payment method, and payment conditions displayed on the relevant interface. Coupons, membership benefits, redemption vouchers, and packages are subject to their applicable scope, validity period, transfer restrictions, refund terms, and partial-redemption rules.
2. Refund, rescheduling, cancellation, and after-sales requests shall be submitted through the Wellness Marketplace order page or customer-service channel. We and the actual service provider will process such requests in accordance with applicable law, the rules displayed on the relevant interface, and the terms of the order. If an adjustment is required due to force majeure, limited service resources, or a third-party cause, notice and an appropriate rescheduling, substitute, or refund arrangement will be provided in accordance with law.
3. You shall not place orders in bad faith, improperly obtain promotions, falsify supporting materials, submit false complaints, or otherwise disrupt transaction order. If any such conduct occurs, we may lawfully restrict promotions, cancel orders, suspend Services, or take other measures, and reserve the right to pursue liability.
X. Intellectual Property and Content Rules
1. Intellectual property rights in the DR H software, interfaces, marks, text, images, algorithmic displays, and other content are owned by us or the relevant rights holders. Without permission, you shall not copy, modify, distribute, reverse engineer, rent, sell, or use any of them for commercial purposes.
2. You are responsible for content that you upload, enter, or submit and represent that you possess all necessary rights. To provide the Services, you grant us a non-exclusive, limited, and revocable authorization to store, process, display, and transmit such content to the extent necessary. Processing of sensitive personal information is subject to your separate consent and the Privacy Policy.
XI. Changes, Interruptions, and Termination of Services
1. We may maintain, upgrade, modify, or discontinue the Services based on business, technical, security, or legal requirements. If a change materially affects Users’ important rights and interests, we will provide reasonable advance notice and any necessary transition arrangements, except as otherwise required by laws or regulations or an urgent security response.
2. If you violate this Agreement or applicable laws or regulations, or endanger the Platform or another person, we may, depending on the circumstances, issue a warning, restrict features, suspend or terminate Services, or take other measures, and may retain necessary records in accordance with law.
XII. Limitations of Liability and Dispute Resolution
1. To the extent permitted by law, we will provide the Services with reasonable skill and care, but do not warrant that the Services will be continuously available, completely error-free, or fully meet all of your requirements. We shall not be liable, or shall bear liability only to the extent permitted by law, for any interruption or loss caused by force majeure, network failure, device failure, third-party service failure, or any cause outside our reasonable control.
2. Nothing in this Agreement excludes or limits liability arising from willful misconduct, gross negligence, personal injury, any consumer right that cannot lawfully be excluded, or any liability that cannot be limited by law.
3. The formation, validity, performance, interpretation, and dispute resolution of this Agreement are governed by the laws of People’s Republic of China. Any dispute arising from or in connection with this Contract shall be submitted to Shanghai International Economic and Trade Arbitration Commission/Shanghai International Arbitration Center for arbitration.
XIII. Updates to This Agreement and Contact Us
1. We may update this Agreement in accordance with law. An update that materially affects Users’ important rights and interests will be notified through an in-App pop-up, push notification, announcement, or another reasonable method; where necessary, we will obtain your consent again. The effective date of the updated Agreement will be displayed on the relevant page.
2. If you have any questions regarding this Agreement, an order, after-sales support, or personal-information processing, please contact us by email at service@doctorhhh.com or by mail at [PRC Company Contact Address].
